The company Sparta sp. z.o.o  headquartered in Bogucin sells building hardware, tools and products derivatives. The company has been operating since 2004, we sell only products new and free from defects. We make every effort to ensure that products sold in the highest degree satisfy your needs both in terms of safety and functional characteristics and aesthetic. We offer a very wide range products of leading Polish and European producers, the absolute majority of them we have in our warehouses which allows for immediate supply them directly to you. We wish to emphasize that our goal is to work for the benefit of our customers and providing them with all possible assistance, any disputes we always try to resolve amicably.

These General Terms and Conditions of Sale are intended to familiarize you with the basic principles of sales expressed in a general way and by using everyday language.

In case of any doubt and the need for clarification, please read the Terms and Conditions of Sale, which is the only legal interpretation of our business in the field of remote sales.

Shop at www.sparta.com.pl sells remote building hardware, tools and commodities derivatives related to construction and interior design industry. We sell only new and free from defects products.

  1. The total price for the product and delivery costs:

The total purchase price includes the gross price (net price plus VAT) for purchased products and delivery costs.

Delivery price depends on the value and weight of chosen assortment.

We do not charge any additional fees for using the online store including license fees etc.

  1. The methods and terms of payment, bank account

Payment for the ordered products can be made at the option of Buyer:

- cash on delivery: payment on delivery into the hands of a courier

- a bank transfer into the Seller bank account; the ordered products are sent after the recognition of Seller's bank account in the amount equal to the price of the ordered products

- cash in hand of the seller - with receipt of the products in the warehouse company in Bogucin;

 

Payment must be made within 7 days from the date of order.

For regular customers it is possible to establish the Seller's trade credit and deferred payment, the payment may take place after receiving the products, according to the due date specified on the sales document.

Thank you for your timely payments.

  1. Delivery time

Standard orders are executed immediately upon receipt, in practice, this means delivery the next business day or within two working days for orders placed until 13.00 on weekdays *.In the absence of products in the warehouse for delivery time may be extended, the maximum delivery time should not exceed 30 days. In the case of implementation of special orders the delivery time is determined individually, and each time the customer is informed about it and the order is implemented after approval of the proposed delivery date.

* The condition of shipment is availability in the warehouse of the company. The delivery date specified on the next business day after shipping applies to an average of ok.95% of cases. Other conditions of delivery according to RULES OF SUPPLIES.

1. Complaints

The company Sparta sp. z.o.o makes every effort to ensure that selling product are free from defects. However, if the client intends to file a complaint it is possible by:

-written notification sent to the Seller

-in electronic form through an e-mail to the following address: sklep@sparta.com.pl

-in person at the headquarters of the Seller.

It is recommended to writing by the customer in the description of the complaint:

  1. information and facts concerning the subject of the complaint, in particular the type and date of occurrence of the defect;
  2. Request a methods of achieving the Product to comply with the Purchase Agreement or statements about reducing the price or withdrawal from the Sales Agreement
  3. the contact details of the complaining - this will facilitate and expedite the consideration of the complaint by the Seller.

Requirements set out in the preceding sentences only take the form of requests and do not affect the effectiveness of the complaints lodged with the description of the recommended without complaint.

After filing the claim the customer will be asked by the Seller to deliver the Product at the expense of the Seller to the address of the Seller.

Seller will address customer complaints immediately, but no later than within 14 calendar days from the date of submission. Failing to respond by the seller within the deadline means that the seller took the complaint to be justified.

Detailed information about the complaints procedure and the possibility of the Client who is a consumer of extrajudicial means of dealing with complaints and redress and rules of access to these procedures are described in the Rules of Sale.

  1. The method of withdrawal
    Client being a consumer may, within 14 days withdraw from the contract without giving any reason and at no cost. (with the exception of the costs referred to in point. VI.9 of the Rules, the cost of returning the goods to Sellers).

The period of withdrawal begins from the day on which the consumer took possession of product or where indicated by the Consumer a third party other than the carrier came into possession of the goods.

In the case of a contract, which includes many things that are delivered separately, in lots or in part the period of withdrawal starts from the day on which the consumer took possession last thing, the last lot or piece, or where indicated by the Consumer a third party other than the carrier has acquired the last of the things that last lot or piece.

To meet the deadline is enough to send a statement before it expires. The statement of withdrawal may be made, for example:

-writing to the Seller

-in electronic form through an e-mail to the following address: sklep@sparta.com.pl

-personally by the Customer at the headquarters of the Seller in Bogucin.

An exemplary model withdrawal form is available in the attached file and in Annex 1 to the Regulations.

Seller (the company Sparta sp. z.o.o.) has a duty immediately, not later than within 14 calendar days of receipt of the declaration consumer of withdrawal, return to the consumer all payments made by him, including the delivery costs products to the customer (excluding additional costs resulting from the Client method of delivery other than the least expensive usual way of delivery available in the Online Shop).

Seller shall refund the payment using the same method of payment, which used consumer, unless the consumer has expressly agreed a different way of return, which does not bind him any costs. Seller may withhold the reimbursement of payments received from the consumer to the receipt of returned product or the consumer has supplied evidence of his return, depending on which event occurs first.

The consumer is required immediately, but no later than within 14 calendar days from the date on which withdrew from the agreement, receive the Seller product or give it to a person authorized by the Seller to receive, unless the seller offered to take back the products himself. The consumer may return the products personally or by a person designated directly to the Warehouse Company.

The consumer shall be liable for any diminished value of the Product as a result of using it in a way that goes beyond what is necessary to establish the nature, characteristics and functioning of the Product.

Possible costs related to the withdrawal by the consumer from the contract, which shall be borne by the consumer:

If the consumer has chosen method of delivery of the products other than plain cheapest shipping method available in the online store, the Seller shall not be obliged to reimburse the consumer incurred by him additional costs.

The consumer pays the direct cost of returning the Product to the Seller.

The right of withdrawal from a distance contract is not entitled to a consumer in respect of contracts:

the provision of services if the seller made a full service with the express consent of the consumer, who has been informed before the provision, (2) in which the price or remuneration depends on fluctuations in the financial market over which Seller has no control, and which may occur before the deadline for withdrawal; (3) the object of which is the provision of non-prefabricated product, manufactured according to the specifications of the consumer or his servant meet individual needs; (4) where the product supplied is undergoing quick deterioration or having a short shelf life; (5) in which the subject of the provision is supplied in packaging sealed that after opening the package can not be returned due to health protection or hygiene reasons, if it were unsealed after delivery; (6) the object of which benefits are products which after delivery, due to their nature, are inextricably linked with other things; (7) in which the consumer has specifically demanded that came to make urgent repairs or maintenance; if the Seller provides additional services other than those where the performance of the consumer demanded or provides products other than replacement parts necessary to perform repairs or maintenance, the right of withdrawal granted to the consumer in relation to additional services or products; (8) the object of which is to provide audio or visual recordings or computer software delivered in a sealed container if the container has been opened after delivery; (9) contained in a public auction; (10) for the supply of digital content which is not stored on a tangible medium if the performance has begun with the express consent of the consumer before the deadline to withdraw from the contract and after having informed by the Seller about the loss of the right of withdrawal.

In case the buyer filed a statement of withdrawal from the contract and sent by him products do not comply with the conditions referred to in point. 1-10 buyer is obliged to accept the products sent back by the Seller.

  1. Guarantees

Seller does not give warranty for their products, but they can be covered by the manufacturer's warranty in accordance with the information contained in a separate document attached to the products or directly on the packaging of the products.

 

Basis and responsibilities of the the Seller in relation to the Customer if the products are sold to natural or legal defect (warranty) are defined generally applicable laws, in particular the Civil Code. According to the art. 558 § 1 of the Code of Civil the Seller liability under the warranty for the product to the customer who is not a consumer is switched off.

 

  1. Digital content and methods of protection

Personal data provided by you in the registration process, ordering or booking products are processed by SPARTA limited liability company, which is the administrator of personal data.

An essential part of the registration process, an order or a reservation of the products by the customer is to give his personal data marked as obligatory and Customer's agreement to the processing of personal data provided during registration, ordering or reservation. Provide personal information marked as obligatory is voluntary, however, necessary in order to register, place an order or to book a commodity, their implementation and maintenance. Providing personal data is not marked as mandatory voluntary.

Consent to the processing of personal data occurs by checking the appropriate box by the customer during the registration process, ordering or reservation products.

The collected personal data are not available to third parties, except for the transmission of data entity involved in the execution of the contract in order to provide the customer ordered products - the products ordered through the Internet shop is supplied to the address specified by the Client indicated in the order.

 

The customer has the right to access their personal data and correct them. To this end, they should contact the Company through an  email to the following address: sklep@sparta.com.pl.

 

The customer has the right to obtain information on whether and to what extent are processed his personal data, as well as information about the purpose and scope of the processing of personal data. To this end, they should contact the Company as indicated in paragraph 6 above.

 

The Company as administrator of personal data, may entrust another entity, by way of a written contract, the processing of personal data in accordance with Art. 31 of the Act of 27 August 1997 on the protection of personal data.

 

Seller uses cookies, which are small text-numeric files that are saved by ICT systems in the ICT system Client (on your computer, phone or other device, from which the connection with the Service) while browsing the Website, including subpage "Shop Online" and allow for later identification of the customer in case of re-connection with the Service from the device (eg. A computer, telephone), for which they were stored.

 

Cookies collect data on the use of the Site, including subpage "Shop Online" by the Client, and their main purpose is to facilitate the client using the Website, customize the Site to the needs and expectations of the customer (personalized pages Service).

 

Cookies files are using in service only after acceptation of the customer. Compatible can be expressed by the Customer through appropriate software settings, in particular web browser, installed in the communication device used by the customer to view the contents of the Website.

The customer may also at any time limit or disable cookies in your browser through the settings to block or warn user before saving a cookie on your device, which is using do view the content of the webside. In such a case, it may happen, however, that use of the Service, including subpage "Shop Online" will be less efficient, you will not have access to certain content and, in extreme cases, it may be completely blocked correct display of the Site, including subpage "shop online ".

Seller is committed to protecting personal data in accordance with the Law on Personal Data Protection and other applicable regulations in this regard. Seller represents that the Internet shop is run using a secure data storage mechanisms.

 

The customer shall not disclose to third parties your login and password to access the online store. Password should be unique and difficult to guess passwords should not be written. The password must be changed at regular intervals.

 

  1. Interoperability of digital content

To use this Online Store, including the viewing range of Internet shop, ordering or booking, it is necessary to fulfillment of the following minimum technical requirements:

- owning a computer or other media device with access to the Internet;

-having a web browser properly configured browser accordance with the standards of Microsoft Internet Explorer version not lower than 5.5, or Opera, Firefox or Chrome in the top version.

- have an active e-mail account (email address).

-the recommended minimum screen resolution for comfortable handling 1024x 768 pixels,

-computer user must have the option of accepting "cookies", with active support JavaScript and INSTALLED Flash plug-in.

1. Extrajudicial ways for dealing with complaints and redress

Detailed information about available by the Client who is a consumer of extrajudicial methods of dealing with complaints and redress and rules of access to these procedures are available on the premises and on the websites of district (municipal) consumer advocates, social organizations to which statutory tasks include consumer protection, Provincial inspectorates of Trade Inspection and at the following sites Office of Competition and Consumer Protection:

The customer who is a consumer has the following examples possibility of using extrajudicial methods of dealing with complaints and redress:

- The customer is entitled to ask the permanent amicable consumer courts referred to in Art. 37 of the Act of 15 December 2000. Trade Inspection (OJ 2001 No. 4 pos. 25, as amended.) a proposal to settle the dispute arising from the concluded Purchase Agreement. Rules of organization and operation of permanent consumer courts of arbitration determines the justice ministry decree of 25 September 2001. On the rules of organization and operation of permanent consumer courts of arbitration. (Journal of Laws 2001, No. 113, item. 1214).

- The customer is entitled to ask the provincial inspector of Trade Inspection in accordance with Art. 36 of the Act of 15 December 2000. Trade Inspection (OJ 2001 No. 4 pos. 25, as amended.) proposing the initiation of mediation proceedings on the amicable settlement of the dispute between Customer and Reseller. Information on the rules and procedures of mediation procedure conducted by the provincial inspector of Trade Inspection is available on the premises and on the websites of the individual Provincial Inspectorates of the Trade Inspection.

- The customer can get free help in the settlement of the dispute between Customer and Reseller, also taking advantage of the free assistance of district (municipal) consumer ombudsman or social organization to which statutory tasks include consumer protection (including the Consumer Federation, Association of Polish Consumers). Tips are granted under the Consumer Federation toll-free consumer helpline number 800 007 707 and by the Association of Polish Consumers email at porady@dlakonsumentow.pl.
